While allowing the All India Youth Congress (TMYC) to hold the rally, the Calcutta High Court said that it cannot ignore Article 19 of the Constitution. The court said this when the Trinamool opposed the West Bengal Police's arguments and cited Article 19 and said that it is its democratic right, which gives it freedom of expression. Live Law reported that the Trinamool Youth Congress has challenged the West Bengal Police's decision to deny it permission for the rally. TMYC had sought permission to hold the rally in protest against various recent incidents. The bench of Justice Saugata Bhattacharya also raised concerns about the rally at the outset and said that it may cause inconvenience to the general public. The party had sought permission to hold the rally from Ballygunge Phadi to Hazra Crossing between 2: 30 pm and 4: 30 pm on Wednesday. The court has allowed the rally on the petitioner's plea that although Article 19 of the Constitution gives every citizen the right to peaceful rally, the senior advocate has asked for the road to be kept open for peaceful movement.
