The Supreme Court, the highest court of the land, on Monday came down heavily on the petitioner while dismissing a PIL. The petition was about freedom fighter Subhas Chandra Bose and his army, the Indian National Army (INA), demanding that the INA be officially credited with India's independence and Netaji be declared the son of the nation. Also, January 23 (Netaji's birthday) and October 21 (INA's foundation day) be declared national days. The petition was filed by Pinakpani Mohanty. Why did the petition get rejected? A bench headed by Chief Justice Surya Kant made it clear that such demands do not fall within the judicial purview. While dismissing the petition, a bench headed by Chief Justice Kant reiterated its disapproval of the growing trend of filing such petitions involving pronouncements on matters related to history and politics, and said in clear terms that such issues are outside the purview of the proceedings of the judiciary.
