Supreme Court Hears Legal Battle Over Shiv Sena Name and Symbol

On Wednesday, the Supreme Court held a crucial hearing in the legal battle between the Uddhav Thackeray and Eknath Shinde faction over the name and symbol of the Shiv Sena. The court asked what the Shiv Sena means, the entire political party, the working committee or the legislative party. Advocate Kapil Sibal, representing the Uddhav Thackeray faction, replied that the Shiv Sena simply means the political party. Separate units are formed to run the party's business, such as the legislature party, the national executive and the House of Representatives. Kapil Sibal gave a full account of the party's rules and democratic system before the court. He said that the Shiv Sena is a rule-driven body, where every small or big change is reported to the Election Commission under Section 29A of the Representation of the People Act. Only the national executive has the right to choose the'party chief'according to the party's rules. Based on this, Sibal argued that the rebel group removed its head of the party without any democratic process and that the Shiv Sena itself was criticized as a direct violation of the working of the General Assembly during the 2018 election.
